Additionally, the IO combination attained a high complete response rate of 9.7%, which compares favourably to a historical control of 0% from anti-PD-1 monotherapy in 1L HNSCC patients with a CPS less than1. Durability of responses is tracking well as has been seen in other clinical trials when efti is combined with Keytruda. The combination also continues to have a favourable safety profile with no new safety signals observed. Immutep will discuss the path forward with regulatory agencies.

The lawsuit sought declaratory relief and a writ of mandamus to compel enforcement of provisions in the Metal Mines Reclamation Act, precluding MDEQ from renewing or issuing exploration and mining permits, including those applicable to the Company's Libby Exploration Project. The plaintiffs alleged that Mr. Baker was a "bad actor" not based on his roles with Hecla, but because of his prior leadership positions with Pegasus Gold in the leadup to its bankruptcy in 1998, and subsequent default on reclamation obligations at the Zortman-Landusky, Basin Creek, and Beal Mountain mines in Montana. With Mr. Baker's recent retirement from the Company, the plaintiffs voluntarily dismissed the lawsuit. With the dismissal of the "bad actor" lawsuit, the Company is focused on advancing permitting of the Libby Exploration Project, a silver-copper project located 23 miles south of Libby, Lincoln County, Montana. The Company's subsidiary owns the HR 133 and HR 134 patented mining claims, in addition to other patented lands, and numerous unpatented mining claims at the Project, and has submitted a Plan of Operations to the U.S. Forest Service, which is currently under an Environmental Assessment review in accordance with the National Environmental Policy Act. The Plan of Operations, if approved, would allow for dewatering and rehabilitation of an existing 14,000' adit, completion of 10,500' of new underground development, and the commencement of exploration activities at the Project.

Nowhere has this been more apparent than during the potential transaction process to separate the Consumer Business, during which directors received material information for the first time via Mr. Kiani's media appearances. The bottom line is that my experience has led me to believe that the Board is unable to carry out its basic functions because it is essentially kept in the dark. As a result, all of Masimo's stakeholders have suffered. Shareholders have repeatedly seen results that miss expectations and have cost the Company its credibility with the financial community while driving down the share price. Employees have to deal with the distraction of two successive proxy contests, bonus cuts and coercion by leadership to demonstrate their "support" for Mr. Kiani. Patients are not the top priority they should be, as the Company invests in unnecessary areas and faces inquiries into recall processes. Masimo has the market position and leading technology to be a growth business. It's my belief that our responsibility as directors is to help make that a reality, by continuing to invest in R&D and enhancing productivity. This is the type of transformation I led at Johnson & Johnson when I successfully returned multiple medical device businesses that had stagnated to above market growth, and it is what I am committed to achieving at Masimo. Ironically, Mr. Kiani and his affiliated directors have made the fear of "disruption" a central theme of their campaign to maintain the status quo. This rings hollow to me. As an experienced operator, I know that the continuation of the problems listed above - in addition to the notion that if Mr. Kiani's affiliated directors view him as "irreplaceable," they will never feel like they can hold him to account - represent massively greater risks than a majority of independent directors sitting on the Board. Over the last few months, I have had an opportunity to get to know Darlene Solomon and Bill Jellison. They are the type of objective, qualified and seasoned directors Masimo needs - particularly at this critical juncture as the Company advances the separation of the Consumer Business. The myriad financial hurdles and nuanced IP transfers that need to be navigated in order to ensure any potential transaction maximizes value for shareholders, while positioning Masimo for success over the long term, are areas where Darlene and Bill have direct expertise. The Board would be lucky to have them. I continue to believe Masimo's best days are in front of it. This is why I urge shareholders to support further change and true independent oversight at Masimo's upcoming 2024 Annual Meeting."

FAP is a mostly inherited condition that puts people at a much greater risk of developing colorectal cancer. Positive 12-month data from a phase 2 clinical trial were recently presented at the 2024 InSIGHT biannual meeting in Barcelona. With FAP, hundreds or thousands of precancerous polyps grow throughout the gastrointestinal tract. There is no approved therapeutic option for treating FAP patients - for whom active surveillance and surgical resection of the colon and/or rectum remain the standard of care. People with FAP, which usually appears in the patient's mid-teens, end up eventually having their entire colon and/or rectum resected and having to carry a colostomy bag for the remainder of their lives . If left untreated, there is a 100% chance the person will develop colorectal cancer. Biodexa believes eRapa could be the first therapeutic option to treat this precancerous condition, and its data so far backs up that assessment. Results of a 12-month phase 2 clinical trial of eRapa demonstrated an overall 17% median decrease in overall polyp burden and an overall non-progression rate of 75%. Even more compelling, of patients in Cohort 2, 89% of patients were deemed non-progressors at 12 months, with a median reduction in polyp burden of 29%. That could be gaming-changing for FAP patients if it means fewer surgeries with much improved quality of life. The 12-month data demonstrate a longevity of effect of eRapa. eRapa is a proprietary oral tablet formulation of rapamycin, also known as sirolimus, which slows down the mTOR protein. Too much mTOR has been linked to cancer. The phase 2 open-label study of 30 adults with FAP was conducted in seven U.S. centers of excellence. The median age of the trial participants was 43 years, with either an intact colon or one with a portion removed and at least ten noncancerous tumors in the rectal remnant. Patients were enrolled in three dosing cohorts, including every other day, daily every other week and daily. Although the primary endpoints were safety and tolerability of eRapa and percentage change from baseline in polyp burden at six months, patients continued to receive treatment and monitoring for 12 months, leading to the new data. Biodexa said the dosing given to cohort 2 - daily every other week - will likely be the preferred dosage regime for its phase 3 trial, which the company is gearing up to launch soon. That study is planned to be a double-blind placebo-controlled design recruiting approximately 140 high-risk patients diagnosed with germline or phenotypic FAP. Biodexa's phase 2 results were presented at InSIGHT by Carol Burke, M.D., a specialist gastroenterologist at the Cleveland Clinic and a leading authority in FAP. Burke is the Principal Investigator for both the phase 2 study and the upcoming phase 3 study. The phase 2 trial was partially supported by $3 million in grant funding from the Cancer Prevention and Research Institute of Texas. CPRIT is providing a $17 million grant for the phase 3 trial.

Litigation in Europe will continue March 25, 2025, with a hearing on the validity of EP 3 708 668 B1, before the Opposition Division of the European Patent Office. The infringement action in relation to this patent was previously suspended pending the validity determination by the European Patent Office. In the German patent litigation against Pfizer/BioNTech, the settlement with Acuitas Therapeutics led to the withdrawal of two utility models covering equivalent claims to the three patents withdrawn in the United States. As previously announced, a hearing before the infringement court of Dusseldorf covering the European patent EP 4 023 755 B1 and the utility model DE 20 2021 004 130 U1, is scheduled for September 10, 2024. Furthermore, a trial in the UK has started on July 10, 2024. It is based on a declaration of non-infringement and request for revocation by Pfizer/BioNTech in the UK for the two CureVac patents EP 3 708 668 B1 and EP 4 023 755 B1. CureVac counterclaimed for infringement. A judgement is expected later in 2024. The trial for the further involved patent EP 1 857 122 B1 will be set for a later time point.
