TSLA | Hot Stocks13:49 EDT Musk threatens to move Tesla's headquarters to Texas, Nevada - After Alameda County's health department said that Tesla's Fremont factory must not reopen because local lockdown measures to curb the spread of COVID-19 remain in effect, CEO Elon Mush said in a series of tweets that, "Tesla is filing a lawsuit against Alameda County immediately. The unelected & ignorant "Interim Health Officer" of Alameda is acting contrary to the Governor, the President, our Constitutional freedoms & just plain common sense! [...] Frankly, this is the final straw. Tesla will now move its HQ and future programs to Texas/Nevada immediately. If we even retain Fremont manufacturing activity at all, it will be dependen on how Tesla is treated in the future. Tesla is the last carmaker left in CA." Reference Link

TSLA | Hot Stocks13:43 EDT Tesla sues California county in factory closure dispute - In a blog post, Tesla said that, "Tesla is the last major carmaker remaining in California, and the largest manufacturing employer in the State with more than 10,000 employees at our Fremont factory and 20,000 statewide. We understand the impacts COVID-19 has caused and have a responsibility to look out for the livelihoods and safety of our personnel, many of whom rely on us and have been out of work for weeks due to the impacts of shelter-in-place orders.cGiven the Governor's recent guidance, which is supported by science and credible health data, the state and federal government's classification of vehicle manufacturing as national critical infrastructure, and our robust safety plan, Tesla has started the process of resuming operations. Our employees are excited to get back to work, and we're doing so with their health and safety in mind.cOur restart plan is the result of months of careful planning and preparation. It was modeled after the comprehensive return to work plan we established at our Shanghai Gigafactory, which has seen smooth and healthy operations for the last three months.cWe are taking the time we need to get our personnel properly trained before they begin work and all employees must complete an online video training before returning to work at any Tesla facility. We have a thorough return-to-work plan for all locations. A cross-functional response team, including an in-house physician, has been working daily to establish health and safety guidelines based on location- and job-specific risk assessments, and we are continuously reviewing our processes to ensure they work for our employees in this new environment. Back in March, we conducted risk assessments at each site, looking at how and where people work, how they interact, and what measures are needed to meet safety standards. In some cases, we have added partitions or barriers to separate work areas and minimized employee interactions by positioning parts closer to where that task is completed on the line. We are also requiring additional personal protective equipment, along with rigorous cleaning and disinfecting protocols. [...] From the State's very first shelter-in-place order, national critical infrastructure, including vehicle manufacturing like Tesla's Fremont factory, was considered vital and given permission to continue operating. The Governor repeated this direction this week when he made clear manufacturing should resume. [...] Contrary to the Governor's recent guidance and support from the City of Fremont, Alameda County is insisting we should not resume operations. This is not for lack of trying or transparency since we have met with and collaborated on our restart plans with the Alameda County Health Care Services Agency. Unfortunately, the County Public Health Officer who is making these decisions has not returned our calls or emails. [...] We will continue to put people back to work in a safe and responsible manner. However, the County's position left us no choice but to take legal action to ensure that Tesla and its employees can get back to work. We filed a lawsuit on May 9 asking the court to invalidate the County Orders, to the extent the County claims they prevent Tesla from resuming operations. Reference Link

AVH | Hot Stocks13:25 EDT Avianca files for bankruptcy to 'preserve, reorganize businesses' - Avianca and certain of its subsidiaries and affiliates today filed voluntary petitions under Chapter 11 of the United States Bankruptcy Code in the U.S. Bankruptcy Court for the Southern District of New York to "preserve and reorganize Avianca's businesses," the company said in a statement. LifeMiles, Avianca's loyalty program, is administered by a separate company and is not part of the Chapter 11 filing. "The filing was necessitated by the unforeseeable impact of the COVID-19 pandemic, which has resulted in a 90% decline in global passenger traffic and is expected to reduce industry revenues worldwide by $314B, according to the International Air Transport Association. Avianca's scheduled passenger operations have been grounded since mid-March, reducing its consolidated revenue by over 80% and placing significant pressure on its cash reserves," Avianca added. Avianca is seeking financial support from the governments of the countries where it provides essential services. Avianca continues to be engaged in discussions with the government of Colombia, as well as those of its other key markets, regarding financing structures that would provide additional liquidity through the Chapter 11 process. In the interim, while these discussions are ongoing, the company intends to utilize its cash on hand, combined with funds generated from its ongoing operations, to support the business during the court-supervised reorganization process. When COVID-19 travel restrictions are lifted, Avianca plans to resume passenger flights with the strictest biosafety protocols.

QDEL | Hot Stocks13:08 EDT Quidel receives EUA for rapid antigen COVID-19 diagnostic assay - Quidel announced that it has received Emergency Use Authorization from the U.S. Food and Drug Administration to market its Sofia 2 SARS Antigen FIA, a rapid point-of-care test to be used with the Sofia 2 Fluorescent Immunoassay Analyzer for the rapid detection of SARS-CoV-2 in nasal or nasopharyngeal specimens from patients meeting the Centers for Disease Control and Prevention's criteria for suspected COVID-19 infection. Sofia 2 utilizes the original Sofia fluorescent chemistry design while improving upon the graphical user interface and optics system to provide an accurate, objective and automated result in 15 minutes. The next-generation Sofia 2 system also comes connected to Virena, Quidel's data management system, which provides aggregated, de-identified testing data in near real-time. The Sofia 2 instrument also offers 2 distinct workflows: depending upon the user's choice, the Sofia 2 SARS Antigen FIA cartridge is placed inside Sofia 2 for automatically timed development; or test cartridges can be placed on the counter or bench top for a manually timed development and then placed into Sofia 2 to be scanned, allowing the user to markedly increase testing throughput per hour. The assay is currently available for sale in the United States under EUA, and Quidel is now shipping the product to its customers. Quidel offers several other Sofia assays for sale, which are FDA cleared and CLIA waived, including tests for Influenza A and B, Respiratory Syncytial Virus, Group A Strep, and a 12-minute finger-stick whole blood test for Lyme Disease.
