In its final decision, the PTAB found all patent claims of U.S. Patent No. 9,531,473 being asserted by Dali Wireless in co-pending litigation are unpatentable. The PTAB ruled that each of claims 6-21 were invalid in view of the prior art submitted by CommScope. "We are very pleased with the decision finding these claims unpatentable," said Matt Melester, senior vice president, Technology Strategy for CommScope. "CommScope's investment to develop more efficient solutions in this field of digital distributed antenna systems goes back many years, resulting in prior patents that predate Dali Wireless's more recent attempts to enter this market." The PTAB's ruling follows a favorable ruling by the Northern District of Texas jury in June validating CommScope's five patents relating to digital distributed antenna systems. Further, due to the jury's finding that Dali willfully infringed each of CommScope's five patents, CommScope will file motions for enhanced damages and attorney fees. In that same litigation, Dali Wireless had included counterclaims in the Northern District of Texas action that relied on the patent claims which the PTAB has now found to be invalid.

11:32 EDT CACI responds to 'erroneous' IRS tax liens - CACI International announced that it is providing information for its shareholders regarding "erroneous" federal tax liens against certain of its subsidiaries. In a statement,t he company said: "In August 2019, CACI learned that the IRS had filed tax liens against seven CACI subsidiaries related to the purported failure of these entities to pay certain employment-related taxes during 2018. After reviewing the matter internally, CACI is providing our shareholders with facts regarding these federal tax liens and confirming that the tax liens are the result of administrative errors and that CACI and each of our subsidiaries have paid all taxes in a timely manner. In 2017, CACI reorganized internally, resulting in the transfer of employees in several CACI subsidiaries to CACI, Inc. - Federal. As a result, those subsidiaries ceased to employ personnel as of December 31, 2017 and were no longer required to pay certain employment-related taxes during 2018. Instead, CACI, Inc. - Federal was responsible for payment of the employment-related taxes and did in fact make timely payment of those taxes. The fact that these subsidiaries ceased to employ personnel was not immediately recognized by the IRS, nor was the fact that CACI, Inc. - Federal had paid the employment- related taxes. As a result, the IRS filed $156M in tax liens against these subsidiaries for certain employment-related taxes which the IRS expected that those subsidiaries would have paid in 2018. CACI is in communication with the IRS to resolve the misunderstanding, and we have provided evidence to the IRS that CACI and each of our subsidiaries have paid the appropriate employment-related taxes for their personnel during the period in question. CACI will continue to work with the IRS to facilitate the resolution of this matter and the release of the tax liens. CACI is highly confident that the matter will be resolved favorably and without financial consequence."

08:43 EDT Sigma Labs CEO says outlook is 'optimistic' - Sigma Labs has released a letter to its shareholders from John Rice, Chairman and CEO. The letter read in part, "The purpose of this letter is to brief you on Sigma Labs' 2019 operational milestones as we cross over the half-way point for the year. In conjunction with a return to quarterly financial and operational updates, I wanted to provide our loyal shareholders with my perspective from the CEO post on the company's four main principal areas in 2019. It's important to note that the final phase of foundation building is now behind us and the stage is set for commercial execution and financial performance. Now let's discuss why all of us at Sigma Labs are excited about 2019 and beyond. Sigma released Version 4.0 of its principal product, PrintRite3D, in November 2018, and Version 5.0 in May 2019... Basically, our PrintRite3D technology solution is being third-party validated and we have no direct competition in delivering actionable in process data as we strive to play a critically necessary role in ensuring quality in industrial additive manufacturing of metal parts... As announced last winter, Sigma had initiated a Rapid Test and Evaluation program to attract customers with a 'drive before you buy' proposition. We quickly discovered the word Rapid was unrealistic because of logistical delays due to clearing machine time for testing and project support personnel. We also made peace with the fact that, since PrintRite3D reveals a precision and depth of quality images and data not previously seen or understood by the customers, RTEs lead to customer requests to extend the scope and issue investigation. That adds time to the process, too. The causes of this absence of rapidness appear to us to improve the prospect for program sales, but of course the reality of slow speed is exasperating. Importantly, so far we have no negative performance issues in the RTE test results!...At this writing, of our two most advanced RTEs in process, looking out over the next 60-120 days, one states an expectation to add a second PrintRite3D installation, and the other to enter the phase two evaluation. ..The company's OEM licensing strategy and negotiations are very important to securing our principal go-to-market goal to have PrintRite3D deployed into the growing marketplace direct from the factory and pre-mounted on the new machines...As mentioned earlier in late July, we announced that Sigma had been selected by Airbus for a Rapid Test and Evaluation program. While this was a very, very important milestone, the impact from a stock perspective was minimized due to a simultaneous capital raise via a shelf offering with Aegis Capital as underwriter. A combination of proper governance and our CFO's strict cash management, we had implemented a plan in the spring of 2019 to ensure the company had ample capital to fund our commercial path in 2019. While timing and market conditions are never perfect, we felt it was the prudent and necessary time to accomplish this goal and provide the company with a stable financial runway. Looking back at the recent stock market volatility this week, we are very confident we made the right decision...In conclusion, our outlook is optimistic because:Our balance sheet is now fortified; Our IP portfolio has a virtual moat around the entire quality control industry for additive manufacturing; Our total addressable market or TAM is in the multi-billions, growing and global; Our RTE program is growing with some of the largest global companies; Machine OEM partnerships are now happening; Software partnerships are now developing with leading providers of additive manufacturing and 3D printing solutions; and Commercial orders are now on the horizon for Q3 2019 with a clear line of sight to breakeven operations by early 2020."

07:56 EDT Engine Capital issues letter to board of Care.com - Engine Capital, a sizeable shareholder of Care.com, issued an open letter to the company's board encouraging the board to initiate a parallel process to explore strategic alternatives while searching for a new CEO and implementing various initiatives identified by Engine. The letter said, "...These discussions have led us to the conclusion that Care.com is a unique asset that is currently underearning, misunderstood by the market and significantly undervalued. The Company is the undisputed leader in a very large and fragmented market. It has the largest supply of caregivers and the largest number of families in a "winner take all" marketplace. It owns a full suite of payment products. It has a strong brand as evidenced by high net promoter scores. It also owns a valuable separate but related business with Care@Work. And yet, despite all these valuable assets, the Company has miserably failed to create any shareholder value over any relevant measurable period as shown in the below table.1 CRCM's current valuation of approximately 1x revenue represents a deep discount to the valuation of other similar online marketplaces and reflects investors' concerns regarding Care.com's business model and future prospects following the March 8, 2019 Wall Street Journal article questioning the Company's safety practices. This article and its surrounding publicity have jeopardized one of the Company's core pillars, namely, the trust in Care.com's services and in the Company's brand itself. This erosion of trust puts the long-term relationship between Care.com and its consumers at risk and creates significant uncertainty in the Company's long-term financial model. The first cracks to this financial model were visible when the Company reported its Q2 2019 results with paying families in the US consumer business declining quarter-over-quarter and traffic negatively affected by word-of-mouth. The reduced traffic generated from word-of-mouth is particularly troubling as it is one of the lowest cost customer acquisition channels. These negative trends, in addition to the increased spend in safety and cybersecurity, are anticipated to significantly detract from the attractive unit economics the Company has previously enjoyed. While we believe many of these issues are fixable, it will take time and there are significant execution risks, including the appointment of a new management team, the restoration of the trust factor and the establishment of new unit economics for the business. At the same time, the Company has significant strategic value and certain buyers may be able to pay a price that is superior to the standalone value of the Company, especially taking into account the time value of money and execution risk. We believe the Board has a fiduciary duty to immediately start a parallel process whereby it continues the search for the Company's next leadership team but at the same time explores the Company's strategic options to assess what a buyer may pay for the Company today... We firmly believe that the Company is at a crossroads and that time is of the essence for significant changes to be made given the Company's persistent underperformance. The Board has a unique window of opportunity to pursue a parallel strategic review process while working on the value enhancing initiatives described above. It is our desire to work collaboratively with the Board to improve the Company and drive shareholder value, which is why we request an opportunity to discuss these important matters further with the Board. We look forward to engaging with you and other shareholders to discuss these topics further."

07:39 EDT JCP CEO says confident company will return to 'sustainable, profitable growth' - "I am pleased with the results we delivered this quarter and the progress we are making against our plan. While we still have work to do on our topline, I strongly believe that growing sales in an unprofitable way is simply not an option. The only way I know how to reconstruct a business, is through a holistic approach across all the key tenets of strategic, purposeful and effective retailing. Notably this quarter, the meaningful improvement we delivered in cost of goods sold was driven by lower permanent markdowns, improved shrink results, increased store and online selling margins and the exit of major appliance and in-store furniture categories. Additionally, we reduced inventory by 12.5 % as we continue to reinstate the discipline required to improve inventory management and productivity. Delivering on our customers' expectations relies heavily on our vendors and the portfolio of brands we offer. The ongoing dialogues and interactions we are having with our vendors are strong and positive - they are equally excited about our direction and are bringing new ideas and innovating with us," said Jill Soltau, chief executive officer of JCPenney. "Today we will begin sharing more insights from where we have been as a company and the holistic approach we are taking to reposition JCPenney to its rightful place in the retail landscape. We have attracted top talent in the industry and each of these passionate leaders made a choice to come to JCPenney at a pivotal time. Together, we are laser-focused on two parallel paths. One is building a framework to reestablish the practices needed to strengthen the day to day operations of our business. Concurrently, we are developing differentiating, transformational initiatives. The journey we are on will restore health back into our company. It is an ongoing process and the proposition we are implementing is for the long-term. We are not simply running a business - we are rebuilding a business. We are making a difference and today, I feel more confident than ever that we will reinvigorate and rejuvenate this great company to sustainable, profitable growth. I will continue providing updates as we move through our business plan and finalize a more comprehensive, long-term strategy for JCPenney."

07:21 EDT Plug Power to showcase results from fuel cell-powered GSE program - Plug Power (PLUG) announced an upcoming event that will showcase the results of Albany International Airport's first hydrogen fuel cell-powered ground support equipment. Originally announced in April 2019, the new GSE fleet at Albany International Airport comprises a contingent of fuel cell-powered electric cargo tuggers tasked with transporting packages from the airport's FedEx (FDX) sorting facility to its delivery airplanes. The vehicles were commissioned in February of 2019 as part of a U.S. Department of Energy program between Plug Power, Charlatte America, and FedEx. The FedEx fuel cell-powered cargo tuggers have posted impressive results after months of operation, and Plug Power's upcoming event will provide media and other attendees with an inside look at the biggest successes and key learnings generated by the project. Additionally, Plug Power will showcase its outdoor hydrogen fueling infrastructure, one of the first outdoor fueling stations built in New York State. Since February, the cargo tuggers have operated 5 days a week, and endured extreme temperatures ranging from 5 degrees F to 91 degrees F. This included 41 days of below-freezing temperatures during the test period. The ground support vehicles were built by Charlatte America and operate using Plug Power's zero emission ProGen hydrogen engines. Electric GSE vehicles produced by Charlatte America offer numerous benefits as compared to industry competitors and require significantly less maintenance than equipment powered by traditional internal combustion engines. Augmented with Plug Power's ProGen hydrogen fuel cell technology, the new FedEx cargo tuggers are capable of towing as much as 40,000 lbs. for up to four hours without stopping, and only require three or four minutes of downtime for each refueling. These zero-emission vehicles are remarkably energy efficient, boasting an average efficiency rating of about 45%. Wear and tear on the vehicle is also considerably lower when compared to other GSEs, meaning they have minimal requirements for routine maintenance such as oil changes, brake service, and starter replacements. As a result, the new vehicles offer an effective means of reducing operational costs while increasing productivity.

McMillon said Walmart: Stopped selling handguns in every state but Alaska in the mid 90s, stopped selling military-style rifles such as the AR-15 in 2015, raised the age limit to purchase a firearm or ammunition to 21 in 2018. He said Walmart only sells a firearm after receiving a "green light" on a background check, while federal law only requires the absence of a "red light" after three business days and said "We don't sell a firearm until we receive a "green light" regardless of the time period." He added that "We videotape the point of sale for firearms, only allow certain associates to sell firearms, and secure firearms in a locking case with individual locks, among other measures." A planned interim analysis was reviewed by an independent Data Safety and Monitoring Committee who unanimously recommended stopping further participant screening and randomization after determining non-inferiority had been met when examining the change in A1c over the treatment period between the two arms. The DSMC concluded that the data collected after 75% of the patients had been randomized was sufficient to support the conclusion that the study had successfully achieved the study's primary endpoint. Because no untoward safety signals were seen, the investigators agreed on August 12, 2019 to end the study early. At this time the use of U-100 Regular Human Insulin with V-Go Wearable Insulin Delivery device has not been cleared by the Food and Drug Administration. 06:12 EDT Sealed Air switches audit firms in light of SEC subpoena - In a regulatory filing, Sealed Air said this week that it's audit committee dismissed Ernst & Young as the company's independent registered public accounting firm effective as of that date. "This change is being made in light of the Company's previously disclosed receipt of a subpoena from the U.S. Securities and Exchange Commission on May 2, 2019 for documents and information relating to the process by which the Company selected its independent audit firm for the period beginning with fiscal year 2015, and relating to the independence of that audit firm. EY has reaffirmed to the Company that EY believes there has been no independence violation, and the Company has not reached a contrary conclusion. Nonetheless, the pendency of the SEC investigation, along with the Committee's dissatisfaction with information it learned about the process by which EY was selected as auditor, caused the Company to make this change now to allow for an orderly transition for the audit of the Company's fiscal 2019 consolidated financial statements and to minimize the risk of disruption that could arise in the event of an unplanned change in independent auditors at an undetermined time in the future." On August 7, 2019, the Committee approved, effective immediately, the engagement of PricewaterhouseCoopers LLP as the company's independent registered public accounting firm for the company's fiscal year ending December 31, 2019.
