CVX | Hot Stocks19:08 EDT DOJ says Chevron to pay $150M to settle Clean Air Act claims - The U.S. Department of Justice, the U.S. Environmental Protection Agency (EPA), and the Mississippi Department of Environmental Quality announced a national settlement with Chevron U.S.A. Inc. that requires safety improvements at all of its petroleum refineries across the United States, resolving claims that the company violated provisions of the Clean Air Act aimed at preventing accidental releases of hazardous chemicals that can have serious consequences for public health and the environment. As part of the proposed settlement, Chevron will spend approximately $150M to replace vulnerable pipes, institute operating parameters and alarms for safer operation, improve corrosion inspections and training, centralize safety authority within the corporation, conduct a pilot study of safety controls for fired heaters, and make other safety improvements at all its domestic refineries. Chevron also will pay a $2.95M civil penalty and will implement supplemental environmental projects worth at least $10M in the communities surrounding the refineries in California, Mississippi, Utah, and Hawaii. The overall value of this settlement exceeds $160M, which makes it the largest settlement in the history of the EPA's enforcement of the Risk Management Plan Rule under Clean Air Act Section 112r. EPA's initial investigation was spurred by an August 6, 2012 fire involving high-temperature hydrocarbons released in the Crude Unit at Chevron's Richmond, California refinery. That fire prompted a shelter-in-place order by Contra Costa County officials, endangered 19 employees, and caused 15,000 local residents to seek medical attention. During EPA's investigation, Chevron experienced accidental releases of regulated chemicals at two of its other refineries, including a 2013 explosion and fire in Pascagoula, Mississippi that caused the death of employee Tonya Graddy, and a 2013 rupture in El Segundo, California that caused a loss of power and flaring at the refinery.

"In the Delaware Basin of West Texas and specifically Ward County, our two well Mesquite Pad has been on production for 20 days and is currently producing over 1400 barrels of oil equivalent per day (including currently flared gas) from two approximate 4800 foot laterals. One lateral is in the lower Third Bone Spring formation, the other is in the upper Third Bone Spring formation. To the best of our knowledge, the upper Third Bone Spring has not been previously tested by industry in our area and represents a new landing zone for Abraxas. From our experience with a conservative flowback protocol, we expect peak production to occur between 45 to 60 days from first production. Abraxas owns an approximate 73 percent working interest in the Mesquite pad. The one well Pecan 47 Pad is currently being prepared for fracture treatment expected to start before mid-November. Abraxas owns a 100 percent interest in this well which has an approximate 4800 foot lateral in the Wolfcamp A-1 zone. The two well Creosote Pad is currently drilling with planned 4800 foot laterals in the Wolfcamp A-1 and A-2 zones. Abraxas owns an approximate 80 percent interest in this pad. Upon completion of drilling operations, the rig will move to our 2 well Hackberry Pad in adjoining Winkler County. Production operations in our Ward County area are proceeding as planned with all wells producing at predicted rates and with no wells currently shut in for frac protection. Due to mechanical issues with our third party gathering and processing, we have experienced various amounts of gas flaring over the past several months. In McKenzie County, North Dakota, four wells on our Ravin Central Pad were successfully fraced with 240 stages. These wells remain shut in for frac protection from our ongoing Ravin Northeast Pad planned 240 stage frac which is currently approximately 25 percent completed. We expect the Ravin Central pad will come on production upon completion of the offsetting frac which should be before mid-November. The Ravin Northeast Pad should follow before the end of November. Abraxas owns varying interests in both pads which average around 48 percent working interest. Our company owned Raven Rig #1 is currently drilling our four well Lillibridge Northwest Pad in which Abraxas owns an approximate 25 percent working interest. These wells, as well as five additional wells planned to be drilled from our Jore Federal Extension Pad over the winter, will remain as DUCs until next summer's frac season. During September and early October, another operator conducting frac operations on six wells offsetting our Stenehjem Super Pad and Stenehjem East Pad to the north necessitated the shut in of 17 high volume wells for a various number of days for frac protection. All wells have currently been placed back on production with no negative effects from the offset fracs. In addition, due to our own fracs on the Ravin Pads, an additional 12 wells were shut in for frac protection. In September, we calculate we lost 1016 barrels of net oil equivalent per day (boepd), or a total of 30,489 boe for the month. Up through October 20, we calculate we have lost 716 boepd or 14,315 net boe for the month. Due to industry success, gas production in North Dakota now exceeds gathering and processing capacity of our third-party processor. Additional infrastructure is under construction but in the interim increasing amounts of gas will have to be flared. During September our flared volumes totaled 688 barrels of oil equivalent per day which includes gas flared in West Texas or 20,627 barrels of oil equivalent for the month. For October up through October 20 our flared volumes in both areas totaled 14,399 barrels of oil equivalent or 720 barrels of oil equivalent per day."

PCAR... | Hot Stocks13:12 EDT Street Fight: Argus cuts Paccar rating on valuation, Piper says buy - Piper Jaffray analyst Alexander Potter upgraded Paccar (PCAR) to Overweight following his firm's fifth annual truck brand survey, which he believes bodes well for the company's pricing and market share. Not as bullish, his peer at Argus cut his rating on the stock to Hold as he believes Paccar's shares are "fairly valued." ARGUS MOVING TO THE SIDELINES: In a research note to investors, Argus analyst John Eade downgraded Paccar to Hold from Buy, saying its shares are "fairly valued" near $57. The analyst acknowledged that due to an industry-wide driver shortage, many operators choose Paccar trucks in an attempt to attract and retain drivers, which he believes is reflected in the company's recent market share gains. Orders for heavy-duty trucks in North America, which fell during the 2011-2017 period, are growing again, he noted, adding that the European market is also showing strength. That said, Eade thinks recent deteriorating growth rates for Paccar indicate that the cyclical market is "near full recovery." From a technical standpoint, "the shares pattern has shifted and the shares have recently been in a bearish trend of lower highs and lower lows that dates to January 2018," he added. Eade would look to move this well-managed company back to his Buy rating list if he sees a pick-up in the industry or more share price stability. Meanwhile, Baird analyst David Leiker argued in a research note of his own that Paccar has underperformed and said he expects additional pressures as investors discount a 2019 cycle peak. He believes the 2019 set up looks challenging for the truck group, citing periods of decelerating or declining order growth. Nonetheless, the analyst said once the cycle turns, Paccar will be one of the first names he revisits. Leiker reiterated an Underperform rating and lowered his price target to $57 from $59 on Paccar shares. PIPER SAYS BUY PACCAR: Following his firm's fifth annual truck brand survey, Piper Jaffray's Potter upgraded Paccar to Overweight, with a $67 price target. The analyst noted that 743 U.S.-based fleets responded to the survey, and like in previous years, Paccar's brands boasted the highest level of brand loyalty. Potter thinks the survey bodes well for the company's pricing and market share, and he would be buying the stock following its recent selloff. Paccar has no debt, a 4% dividend yield, an active buyback program, and a current valuation of 9 times FY19 EPS, the lowest in nearly a decade, he contended. PEER RATING CUT AT PIPER: Piper Jaffray's Potter pointed out that, by contrast, Navistar's (NAV) survey scores were weaker than expected, and with interest rates rising, he thinks investors will favor stocks with less leverage. The analyst downgraded the stock to Neutral from Overweight and lowered his price target on the shares to $37 from $44. Navistar's market share fell by more than 50% after an emissions crisis nearly drove the company into bankruptcy, he noted, adding that with a refreshed product lineup and backing from Volkswagen (VLKAY), he still expects the company to win back some of these losses. However, the analyst noted that after reviewing the results from his survey, he now expects Navistar's share to rise more slowly than he had originally anticipated. PRICE ACTION: In afternoon trading, shares of Paccar have dropped almost 4% to $55.33.

XOFLUZA is a first-in-class, single-dose oral medicine with a novel proposed mechanism of action that inhibits polymerase acidic endonuclease, an enzyme essential for viral replication. XOFLUZA has demonstrated efficacy against a wide range of influenza viruses, including oseltamivir-resistant strains and avian strains in non-clinical studies. XOFLUZA was approved based on results from the Phase III CAPSTONE-1 study of a single dose of XOFLUZA compared with placebo or oseltamivir 75 mg, twice daily for five days, in otherwise healthy people with the flu, as well as results from a placebo-controlled Phase II study in otherwise healthy people with the flu. XOFLUZA significantly reduced the duration of flu symptoms compared to placebo, and demonstrated similar efficacy compared to oseltamivir. In clinical trials, XOFLUZA was safe and well-tolerated with a side effect profile similar to placebo. The CAPSTONE-1 and Phase II study results were recently published in the September 6, 2018 issue of the New England Journal of Medicine. XOFLUZA will be available across the U.S. in the coming weeks.

"Our list of CR recommended vehicles is determined, in part, by how the vehicles perform in CR's exclusive Annual Reliability Survey. This year we collected data from CR members on more than 500,000 vehicles." CR says Tesla's Model S lost its recommendation "largely because of suspension problems reported by CR members in the survey. Tesla made air suspension and all-wheel drive standard in its 2017 Model S." A Tesla spokeswoman told CR that some Model S owners experienced suspension problems primarily in 2017. She said that the problem was supplier-related and that the automaker already had addressed it. She pointed out that there was an unrelated false service alert that some customers received this year regarding their suspension. That problem was corrected via an over-the-air software update within two weeks of being reported, she said. The Odyssey minivan had much-worse-than-average reliability, with problems including the infotainment display freezing and losing all functionality, and power sliding doors that wouldn't close. The Honda spokesman said that the automaker released over-the-air software updates. Software updates issued by Honda can be downloaded by the customer using any WiFi connection. As for the door problem, the spokesman said Honda is aware of some instances, and plans to issue a service bulletin with specific dealer repair guidance soon. Reference Link

BUY LOCKHEED MARTIN: In a research note to investors, Goldman Sachs' Poponak upgraded Lockheed Martin to Buy from Neutral and added the shares to his firm's Conviction List. The analyst believes Lockheed increasingly looks to have outgrowth differentiators in an end-market he favors, namely Defense, and sees margins expanding from current levels in every segment. Further, Poponak argued that free cash can convert at a high rate for a long time and said he sees upside to consensus estimates. The recent pullback in shares makes the stock's valuation more attractive, he added. Additionally, the analyst continues to expect higher future defense spending than the market discounts and now sees greater potential for outgrowth given developments in missile, missile defense, helicopters and space, in addition to remaining F-35 growth. SAUDI ARABIA DEAL UNCERTAINTY: Lockheed Martin's $15B sale of its THAAD missile system to Saudi Arabia may be at risk in the aftermath of the murder of journalist Jamal Khashoggi at the Saudi consulate in Turkey, according to Bloomberg. The pending Saudi deals for arms, logistics and training includes sales started during President Barack Obama's administration, and only $14.5B of that involves signed "letters of offer and acceptance" that spell out final terms and prices. Citing the company's CEO Marillyn Hewson, the Washington Post said Lockheed would defer to the U.S. government's decisions regarding relations with the kingdom. "Most of these agreements that we have are government-to-government purchases, so anything that we do has to follow strictly the regulations of the U.S. government," she said in response to a question from Bernstein analyst Doug Harned during the company's earnings call yesterday. "Beyond that, we'll just work with the U.S. government as they're continuing their relationship with Saudi." Howell of the 459th Travis County District Court has issued a letter ruling granting the company's Motion to Dismiss the securities class action complaint brought against XBiotech. On December 1, 2015, a purported securities complaint was filed against the Company, certain of its officers and directors and the underwriter for its initial public offering in the Superior Court for the State of California, Los Angeles County. In the OVATION I Study, complete tumor resections were achieved for all patients receiving the highest dose of GEN-1, and approximately 86% of patients in OVATION I had a complete or partial response. Patients administered GEN-1 and NAC demonstrated meaningfully longer PFS compared to the historical average for chemotherapy alone, with longer PFS observed in the higher dose cohorts. GEN-1 was well tolerated and no dose-limiting toxicities were detected. Intraperitoneal administration of GEN-1 was feasible with broad patient acceptance.

It explained, "When conducting this subgroup analysis on pooled data from both the A-Study and B-Study and comparing change from baseline at 12 months (B-Study was discontinued at 12 months), the azeliragon subgroup (n=33) demonstrated a 3.5 point benefit on ADAS-cog (p = 0.01) relative to the placebo group (n=22), and a 0.7 point benefit on CDR-sb (p = 0.24) relative to placebo." These data indicate that benefit for the patients in the memantine-free group increase with dosing over time, including throughout the 15 week protocol. Two advertisements for Ford, shown only in movie theaters and on YouTube, featured a voice over that quoted a Dylan Thomas poem with the lines "Do not go gently into that goodnight. Old age should burn and rave at close of day. Rage. Rage against the dying of the light." The Advertising Standards Authority found that the ad helped to suggest "that driving was a way of releasing anger, which put the driver, other motorists and pedestrians at risk." Zanubrutinib was discovered in BeiGene's research facilities in Beijing, China, and is being developed globally by BeiGene as a monotherapy and in combination with other therapies to treat various hematologic malignancies. In August, the NMPA accepted BeiGene's first NDA for zanubrutinib for the treatment of patients with R/R mantle cell lymphoma, or MCL. The NDA is supported by an extensive clinical, non-clinical and chemistry, manufacturing and control data package, including the results from a 91-patient single-arm pivotal Phase 2 study in Chinese patients with R/R CLL/SLL treated with zanubrutinib, dosed at 160 mg orally twice daily. An independent review of response data from this study, with a data cut-off of June 15 and a median follow-up of 9.1 months, showed an overall response rate, or ORR of 80%, inclusive of complete response, partial response and partial response with lymphocytosis. The median duration of response has not been reached, as a majority of the responders remain in a response. The safety profile was consistent with previously reported clinical data for zanubrutinib. Updated data with additional follow-up of the patients in the study will be submitted to the NMPA as an additional document of the NDA and are planned to be presented at an upcoming medical conference. Zanubrutinib is being evaluated in a broad global registration program, including a fully enrolled Phase 3 clinical trial in patients with WM, comparing zanubrutinib with ibrutinib, the currently approved BTK inhibitor for WM. Zanubrutinib is also being studied in comparison to bendamustine/ rituximab in a Phase 3 clinical trial in patients with previously untreated CLL/SLL, as well as in a pivotal randomized Phase 2 trial in combination with Gzayva in patients with R/R follicular lymphoma. In China, besides the pivotal Phase 2 trials in R/R MCL and R/R CLL/SLL, BeiGene has completed enrollment in a pivotal Phase 2 clinical trial in patients with WM. BeiGene also plans to initiate a Phase 3 trial comparing zanubrutinib to ibrutinib in patients with R/R CLL/ SLL.

Separately, Travelport is turning to the IBM Watson Data Platform to personalize customer experiences with new tools and traveller recommendations.In the first of two programs, Travelport is moving into the next phase of development using IBM Blockchain to streamline the hotel and in-trip experience ecosystem. Providing choices through content, seamless booking and fulfilment experience is crucial to traveller satisfaction. In recent years, travelers' interest in unique experiences, as they look for content to share on social media platforms, has grown. Through blockchain, travellers, experience providers and hotels can see notable benefits around the management and increased availability of so called 'long tail content'. Travel agencies, whether brick-and-mortar, online or corporate travel managers, have faced many challenges with 'long tail content' due to the diverse nature of travel services and products, the large number of travel suppliers and their limited technical capabilities. Processing settlements across a diverse range of suppliers can be complicated and the entire process to reach a completed transaction often takes time. Consequently, agencies are often unable to sell the content due to issues in traveller experience and the cost of processing. The transaction is expected to close in early 2019, subject to regulatory approvals of the Competition Commission of India and other customary closing conditions. Under the terms of the agreement, Kraft Heinz will sell to Zydus Wellness Limited, jointly with Cadila Healthcare, 100% of its equity shares in Heinz India Private Limited, which is comprised of Complan, Glucon-D, Nycil and Sampriti brands, and two manufacturing facilities, with approximately 900 employees associated with these brands and operations.
