The ALJ's recommendations are not binding on the Minnesota Public Utilities Commission and Enbridge expects the PUC to vote on the Line 3 Replacement Project in June 2018. Commenting on the ALJ recommendation, Al Monaco, President & CEO, Enbridge Inc. said: "We are pleased that the ALJ's recommendation clearly confirms the need to replace this critical piece of infrastructure that will enhance safety and environmental protection with the latest in pipeline technology and construction methods. The ALJ recommendation also recognizes the economic importance of a modernized Line 3 that will have significant benefits to businesses and communities across Minnesota. That being said, the ALJ's suggestion of an alternative route ignores the extensive record compiled by the State of Minnesota in issuing a comprehensive Environmental Impact Statement that incorporates input from thousands of Minnesotans who are in favor of our proposed route. Most notably, the ALJ's recommended route ignores the longstanding wishes of the Leech Lake Band of Ojibwe that the replacement not be constructed across their reservation." The ALJ's recommended route would require in-trench replacement of the existing pipeline in the current right-of-way, introducing unnecessary safety, environmental and economic risks. Constructing RA-07 would require lengthy pipeline outages, which would cause extended supply disruptions leading to higher gasoline prices impacting Minnesota and the surrounding region.

Two subsequent REMS assessments were conducted following Afrezza's approval, and both assessments found that the communication plan met its goals.The release of the REMS means that no further assessments are necessary; had it not been released, additional assessments would have been conducted at seven years post-approval.

14:19 EDT ConocoPhillips says tribunal rules company owed $2.04B in PDVSA dispute - ConocoPhillips announced that it is owed $2.04B from Petroleos de Venezuela, , or PDVSA, and two of its subsidiaries as a result of the decision of an international arbitration tribunal constituted under the rules of the International Chamber of Commerce. The ruling arises out of ConocoPhillips' contracts with those entities and is in response to the expropriation of ConocoPhillips' investments in the Hamaca and Petrozuata heavy crude oil projects in Venezuela in 2007 and other pre-expropriation fiscal measures. PDVSA is Venezuela's state-owned oil company. The ICC arbitration award is final and binding upon the parties. ConocoPhillips will pursue enforcement and seek financial recovery of its award to the full extent of the law. "We are pleased with the ICC tribunal's decision. The ruling upholds the contractual protections to which ConocoPhillips is entitled under the applicable agreements and acknowledges PDVSA's independent contractual liability arising from the government of Venezuela's unlawful and uncompensated expropriation of ConocoPhillips' investments," said Janet Langford Carrig, senior vice president, Legal, general counsel and corporate secretary of ConocoPhillips.

14:10 EDT Acadia falls after FDA said to open re-examination of Parkinson's drug - Shares of Acadia Pharmaceuticals (ACAD) have fallen over 11% in afternoon trading after CNN reported that the FDA has begun conducting a new evaluation of the company's Nuplazid drug, which is indicated for the treatment of hallucinations and delusions associated with Parkinson's psychosis. After CNN previously had published an article stating that hundreds of patients receiving Nuplazid had died, the FDA told the San Diego Union-Tribune on April 11: "We have noted that the cases typically involve geriatric patients with advanced-stage Parkinson's disease, as well as numerous medical conditions, who are frequently taking concomitant medications with risks for serious adverse events, including death. Based on these data, the FDA has, at this time, not identified a specific safety issue that is not already adequately described in the product labeling." However, CNN stated in its new report that the agency said the decision to conduct a new evaluation of Nuplazid was based on a number of factors, adding that it identifies "potential signals of serious risk/new safety information" in part by using adverse event data and that the agency is not suggesting physicians stop prescribing the drug or take patients off of it while a safety evaluation is taking place.

The FTC says in a lawsuit LendingClub falsely promised consumers they would receive a loan with no hidden fees, "when, in actuality, the company deducted hundreds or even thousands of dollars in hidden up-front fees from the loans." As stated in the FTC's complaint, LendingClub recognized that its hidden fee was a problem for consumers, and an internal review noted that its claims about the fee and the amount consumers would receive "could be perceived as deceptive as it is likely to mislead the consumer." An attorney for one of the company's largest investors also warned the company that the "relative obscurity" of the up-front fee in light of the company's prominent "no hidden fees" representation could make the company a target for a law enforcement action, the agency said in a statement. According to the FTC, Lending Club ignored these and other warnings and, over time, made its deceptive "no hidden fees" claim even more prominent. The FTC also alleges that Lending Club falsely told loan applicants that "Investors Have Backed Your Loan" while knowing that many of them would never get a loan, a practice that delayed applicants from seeking loans elsewhere. The company is charged with violating the FTC Act and the Gramm-Leach-Bliley Act. Shares of LendingClub are down 8%, or 25c, to $3.01 in afternoon trading. Reference Link

UPDATED SNAPCHAT FORMAT: According to media reports out late Tuesday, Snap, which describes itself as a camera company, said it will be revamping its redesign it introduced late in 2017. Tuesday night's report from Recode said "Now Snapchat is rolling out a redesign to the redesign for a small group of users -- it's taking user-generated Stories and putting them on the Discover page, where they'll exist alongside stuff from brands, celebrities and publishers -- similar to how they did before the redesign was rolled out." The Recode report included a statement from a company spokesperson: "We are always listening to our community and will continue to test updates that we hope will give Snapchatters the best possible experience on our platform." ORIGINAL REDESIGN: The original Snapchat redesign was focused on separating the content created by peoples' friends from the content created by brands, celebrities, and publishers. The earlier redesign allowed Snapchat to continue opening as a camera but it promised to have a more distinct separation between content from friends and content from publishers. Snap's CEO Evan Spiegel said at the time, "One of the complaints we've heard about social media is that photos and videos from your friends are mixed in with content from publishers and creators and influencers," The first redesign faced immediate criticism with users and the backlash was fueled by celebrity tweets like the one from Kylie Jenner in late February: "sooo does anyone else not open Snapchat anymore? Or is it just me... ugh this is so sad." The April 2018 Proposed Rule for the Inpatient Prospective Payment System, or IPPS, update includes ICD-10 coding and assignment of percutaneous Impella implantation to MS-DRG 215 for Other Heart Assist System Implant. The Proposed Rule also maintained bi-ventricular Impella support in MS-DRG 1-2 assignments, and Impella hospital transfer and support in MS-DRG 268-269 for the receiving hospital. "Impella related procedures were previously assigned to MS-DRG 216-221 for assistance in the catheterization lab only, and were reimbursed at a lower rate than MS-DRG 215 and MS-DRGs 1-2. The final rulemaking may differ substantially from this proposal and will take effect October 1, 2018. The MS-DRG 215 proposed rate is lower than the previous year based on the CMS process to evaluate hospital charges, length of stay, patient comorbidities and takes into effect hospital efficiencies over the prior year. The American Hospital Association and CMS have completed a system of care around the utilization of percutaneous heart pumps. A designated DRG 215 code will simplify coding and enable hospitals to receive payment in multiple settings and indications. This IPPS update also reflects the recent expansion of Impella indications from the U.S. Food and Drug Administration for High Risk Percutaneous Coronary Intervention, Cardiogenic Shock, and Bi-Ventricular Support. This comes only a week after the U.S. announced that it had placed a ban on selling to Chinese telecom equipment maker ZTE Corp. (ZTCOY) for seven years for violating the terms of a sanctions violation case. HUAWEI UNDER INVESTIGATION: The Justice Department is investigating whether Huawei violated U.S. sanctions related to Iran, according to The Wall Street Journal, citing people familiar with the matter. It is not clear how far the DOJ probe has advanced, the report added. Last week, the U.S. Department of Commerce banned U.S. companies from selling components to Chinese telecom equipment maker ZTE Corp. for seven years for violating the terms of a sanctions violation case, sending shares of makers of optical components, including Oclaro (OCLR), Acacia Communications (ACIA), NeoPhotonics (NPTN), Lumentum (LITE), and Finisar (FNSR), into negative territory. ZTE previously pleaded guilty of illegally shipping U.S. goods and technology to Iran. OTHERS TO WATCH: Commenting on last week's news, B. Riley FBR analyst David Kang told investors that he believes the optical component companies most directly impacted by the U.S. ban on selling components to ZTE are Acacia and Oclaro, noting that ZTE represented 30% and 18%, respectively, of their total FY17 annual sales. Additionally, Kang pointed out that Finisar and NeoPhotonics supply to Huawei, not ZTE, and he expected they would not be impacted by the ZTE announcement. Acknowledging that all component makers traded down on ZTE's news, MKM Partners analyst Michael Genovese told investors in a research note of his own that he expects Huawei and Nokia (NOK) to gain share at ZTE's expense. He also noted that NeoPhotonics had 40% exposure to Huawei and much smaller ZTE exposure. Additionally, the analyst said Lumentum, Oclaro and Finisar have significantly more Huawei and Nokia exposure than ZTE exposure. PRICE ACTION: In morning trading, shares of Finisar have slipped 4%, while NeoPhotonics and Inphi dropped 11%. Achieving a 75 percent or greater response rate was associated with more meaningful improvements in bodily pain and physical function at week 12, as measured by a quality of life patient-reported survey. The observed safety profile for PROMISE 1, to date, is consistent with previously reported eptinezumab studies. The most commonly reported adverse events occurring at an incidence of 5 percent or greater across all eptinezumab treatment groups were upper respiratory infection, nasopharyngitis and sinusitis.

FES, its subsidiaries and FirstEnergy Nuclear Operating Company on March 31, filed petitions under Chapter 11 of the Federal Bankruptcy Code. The closure of the plants will affect about 2,300 plant employees. The total capacity of the nuclear plants to be deactivated is 4,048 MW. In 2017, the nuclear units contributed approximately 65% of the electricity produced by the FES generating fleet. The two nuclear plants in Ohio represent 14% of the state's overall generation capacity; the Beaver Valley units represent 7% of Pennsylvania's overall generation capacity.

For example, last quarter we implemented changes to TweetDeck and the Twitter API - two of the most common ways spam is placed on our service - to limit the ability to perform coordinated actions across multiple accounts. Early results from this change show roughly 90% fewer users creating fake or automated engagement spam via TweetDeck. Additionally, in Q1, we removed more than 142,000 applications connected to our Twitter API in violation of our developer rules - collectively responsible for more than 130 million low-quality Tweets during the same period." 08:20 EDT General Electric, U.S. Army conduct PDR for T901 engine - GE Aviation hosted the U.S. Army for the successful preliminary design review, or PDR, of the T901-GE-900 engine in early March. The T901 is GE Aviation's engine for the Improved Turbine Engine Program, or ITEP, the U.S. Army's undertaking to re-engine its Boeing AH-64 Apaches and Sikorsky UH-60 Black Hawks. The PDR is a major milestone within the Technology Maturation and Risk Reduction, or TMRR, contract, a $102M, 24-month contract the Army awarded GE in September 2016. The Army is in the process of down selecting to one engine manufacturer for the engineering and manufacturing development phase by the end of 2018. The U.S. Army Contracting Comman, or ACC, released its request for proposals for the EMD last November. GE Aviation submitted the first phase of the proposal in February and is currently preparing the second and final phase of its proposal based on the engine configuration reviewed at the PDR. GE Aviation successfully completed a fit test with the Army this past December using a full-scale engine mockup. It demonstrated that the T901 engine seamlessly integrates with the Apache and Black Hawk airframes. GE's experience in powering these aircraft missions with the T700 engine over the past four decades has informed its development of the T901; it positions the Army and GE to make a smooth transition from the T700 to the T901. GE has invested more than $9B in maturing commercial technologies applicable to the T901 and more than $300M to develop and test turboshaft-specific technologies ahead of the PDR. GE funded and successfully completed testing a T901 prototype engine, as well as component tests. These company-funded investments demonstrate GE's commitment to providing only the most advanced technologies available to the Warfighter and the Department of Defense.

08:19 EDT Zogenix announces new safety, efficacy data from Phase 3 clinical trial of ZX008 - Zogenix announced additional data from analyses of its first Phase 3 trial of the Company's investigational drug, ZX008, for the adjunctive treatment of seizures associated with Dravet syndrome. Top-line results from Study 1 were previously reported in September 2017. The additional Study 1 results were presented in two late-breaker poster presentations at the Emerging Science session at the 2018 American Academy of Neurology Annual Meeting being held April 21-27 in Los Angeles, California. As previously reported, Study 1 met its primary objective of demonstrating that ZX008, at a dose of 0.8 mg/kg/day, is superior to placebo as an adjunctive therapy in the treatment of Dravet syndrome in children and young adults based on change in the frequency of convulsive seizures between the 6-week baseline observation period and the 14-week treatment period. The first poster, presented by Elaine C. Wirrell, M.D., Director of Pediatric Epilepsy at the Mayo Clinic, showed the results of a post-hoc analysis evaluating the effect of ZX008 in enrolled patients in Study 1 who had previously failed treatment with stiripentol, which is currently the only medication for adjunctive treatment of seizures in patients with Dravet syndrome, approved in Europe, Australia, Canada, and Japan, and available via compassionate use in the U.S. For purposes of this subgroup analysis, failed treatment included patients who discontinued for reasons of efficacy or tolerability, both efficacy and tolerability, or any other reason. A total of 58 subjects from Study 1 were included in this post-hoc analysis, consisting of the following treatment groups: ZX008 0.8 mg/kg/day, ZX008 0.2 mg/kg/day and placebo. In this subgroup of patients, ZX008 demonstrated robust antiseizure activity in patients who failed prior treatment with stiripentol. The efficacy and tolerability results in this subgroup were comparable to those achieved in the full Study 1 population. In the post-hoc analysis, patients taking ZX008 0.8 mg/kg/day achieved a 60.8% greater reduction in mean monthly convulsive seizures compared to placebo. In the full Study 1 population, patients taking ZX008 0.8 mg/kg/day achieved a 63.9% greater reduction in mean monthly convulsive seizures compared to placebo/ Other select endpoint comparisons are presented below. The post-hoc analysis showed a consistent safety and tolerability profile, as previously seen in the full Phase 3 trial population. The most common treatment emergent adverse events in this subgroup of patients included decreased appetite, lethargy, fatigue, diarrhea, upper respiratory tract infection, nasopharyngitis, pyrexia, and somnolence. The most common treatment emergent adverse events in the full Study 1 population included diarrhea, vomiting, fatigue, pyrexia, nasopharyngitis, upper respiratory tract infection, fall, weight decreased, decreased appetite, lethargy, seizure, and somnolence. As reported for the full Study 1 population, there was no clinical and/or echocardiographic evidence of cardiac valvulopathy or pulmonary hypertension in any patient at any time during the study. No patient discontinued participation or required a change in monitoring in the study due to cardiac factors in this subgroup or the full Study 1 population. A second poster presented by Joseph Sullivan, M.D., Director of the Pediatric Epilepsy Center at University California San Francisco, et al., highlighted the results of a prespecified secondary analysis evaluating the effect of ZX008 on total seizure frequency in the full Study 1 population. A total of 119 patients were randomized to treatment in Study 1. During baseline, the median monthly TS frequency ranged from 40.7 to 53.9 in the three groups. At endpoint, after the 14-week treatment period, median percent changes in TS frequency were -13.1% in placebo, -34.3% in ZX008 0.2 mg/kg/day, and -70.1% in ZX008 0.8 mg/kg/day.

The company sees 3%-5% baseline gross inflation in manufacturing costs, including synthetic gypsum which is expected to be up around $10M due to higher transportation costs. USG sees FY18 net interest expense $60M and sees FY CapEx around $250M, including about $90M for Advanced Manufacturing, about $95M for growth investments and about $65M for maintenance. The company also sees new residential starts of around 1.25M for 2018 from 1.2M. Sees low to mid single digit growth in non-residential starts, mid single digit growth in repair and remodel and low single digit growth in USG ceiling volumes. USG's portion of USG Boral adjusted net income is expected to increase in the low to mid single digit percentage range in FY18.

Entasis and Zai Lab will cooperate in conducting a pivotal Phase 3 trial in China, with Zai Lab taking the lead by conducting the screening, enrollment and treatment of patients, and coordinating development, registration and commercialization of ETX2514SUL in the territory. In addition, Entasis and Zai Lab have an option to collaborate on the development and commercialization of ETX2514 in combination with other active ingredients. A joint steering committee will be formed between the companies to oversee development, regulatory and commercialization activities in the Asia-Pacific territory. In STAR 2, longer term exposure to ZYN002 resulted in greater improvements in seizure frequency among all ZYN002-treated patients; Longer term exposure to ZYN002 appeared to result in clinically meaningful reductions in seizures both across and within originally randomized STAR 1 patient groups:Compared to baseline, the median changes in seizure rates at months 3, 6, 9, and 12 of STAR 2 across all ZYN002-treated patients at each time point were: 25% reduction at month 3, 36% reduction at month 6, 49% reduction at month 9, 58% reduction at month 12. ZYN002 was well tolerated with good skin tolerability; In STAR 2, the most common treatment-emergent AEs were upper respiratory tract infection and headache. These systemic drugs offer good efficacy, however, as biologics they can cause serious side effects. The psoriasis therapeutic market is estimated to reach $11.4B in 2020 according to Visiongain. Piclidenoson binds to the Gi protein associated A3 adenosine receptor, which is over-expressed in psoriasis patients. This binding action has shown to induce a robust anti-inflammatory effect by inhibiting IL-17 and IL-23 as demonstrated in the in-vitro studies presented in the paper. An orally administered small molecule drug, Piclidenoson, potentially offers safety superior to biologics as shown in clinical studies in more than 1,000 people. The Company has completed the preparatory work for its COMFORT Phase III Psoriasis study, designed to evaluate the efficacy and safety of daily Piclidenoson, administered orally compared to Apremilast and placebo in around 400 patients with moderate-to-severe plaque psoriasis. The study will be conducted in 5 countries in Europe, Israel and Canada. The study protocol has been already submitted to the IRB in Israel, which will be the first country and patient enrollment is scheduled to be initiated this quarter. Additionally, Comcast reaffirmed the following statements of intention given in its Rule 2.4 announcement on February 27, 2018: Continue to support the creative industries in the UK and increase investment in UK film and TV production; Support innovation in the UK by continuing to support Sky's technology hub in Leeds; Continue to support young people in the UK by maintaining Sky's Software Engineering Academy scheme; and Continue to support Sky's local community sports programs in the UK. Comcast believes that, combined, Comcast and Sky will create a business equipped to compete more effectively in a rapidly changing and highly competitive industry. Together, the companies would be well positioned to drive growth to provide attractive returns to Comcast shareholders and to benefit the employees and customers of both organizations. Under the terms of the Acquisition, Sky shareholders will be entitled to receive GBP 12.50 in cash for each Sky share. The beach-front property will be situated in the Puerto Los Cabos Tourist Corridor and the San Jose del Cabo resort city on the southern tip of the Baja California peninsula. Puerto Los Cabos is a prime market for the introduction to the expansion of the Caesars brand in North America. The number of airline passengers into the market has risen 40% since 2015 with the majority coming from the United States and Canada followed by Mexico.

By adapting the design of clinical trials to suit the daily routine of patients, the app may reduce barriers to participation, leading to a more nuanced understanding of ophthalmic diseases and potentially accelerating the development of novel treatments. Data capture in traditional ophthalmic clinical trials can be inflexible and infrequent, making it difficult for researchers to monitor patients' disease activity and capture real-world patient experiences. FocalView aims to help patients complete various assessments, gaining feedback on their visual function, including any changes over time. At the same time, the app could provide researchers with a greater volume of real-world, patient-reported data, creating more flexible and accessible clinical trial designs. FocalView will be tested in a prospective, non-interventional study to evaluate the app's efficacy and usability in assessing visual function. These measurements include visual acuity and contrast sensitivity. Researchers will in turn assess ease of use, level of enrollment and the ability to obtain important documentation for future clinical trial research, such as informed consent. In the next phase, the app will be validated against traditional visual testing that takes place within conventional clinical settings. FocalView is now available for download from the App Store in the U.S. Consent to contribute to research data will be required before a user can interact with the tool. Novartis is planning to launch in additional markets in the future.
