JNJ... | Hot Stocks15:30 EDT Johnson & Johnson diabetes data seen as boon for Eli Lilly - Johnson & Johnson (JNJ) reported data Monday night from cardiovascular trials of its diabetes treatment Invokana, showing arguably mixed results as the drug lowered disease risk while increasing the risk of amputations, an outcome which Wall Street said could lift similar but safer drugs in the space. INVOKANA DATA: Last night, Johnson & Johnson reported results from the "CANVAS" trials of its already-approved SGLT-2 inhibitor Invokana, saying the drug significantly lowered risk of cardiovascular death, myocardial infarction, and nonfatal stroke in type 2 diabetes patients at risk or with history of heart disease, while also registering a potential kidney benefit. However, the two trials also showed nearly double the risk of amputation, with the company cautioning that those safety findings "have been shared by the U.S. FDA and will be reflected in the U.S. prescribing information." PLUS FOR LILLY, MINUS FOR MERCK: Credit Suisse analyst Vamil Divan argues that CANVAS nearly paints a best case scenario for Eli Lilly (LLY) and its Jardiance drug. Invokana validates the previous efficacy data for Jardiance as well as hospitalization rate and possible kidney protection, which "bodes well" for Lilly's ongoing studies in those populations. Meanwhile, the increased amputation risk -- while potentially outweighed by Invokana's benefits -- and consequent label warnings "will likely lead to a significant commercial advantage" for Eli Lilly, Divan contends. Conversely, Merck's (MRK) Januvia product, which belongs to a different class of diabetes medicines, may face "incremental pressure" over time as enthusiasm around the CANVAS efficacy data likely pushes SGLT-2 inhibitors to the forefront of the treatment cycle. COWEN POSITIVE: Keeping an Outperform rating and $143 target on Johnson & Johnson, Cowen analyst Joshua Jennings calls Invokana's positive efficacy data "crucial" for its competitive positioning and supportive of his current forecasts, while also boding well for the larger SGLT-2 drug class. He remains "optimistic" that digestion of the data will yield a broad label, similar to Jardiance. NEGATIVE MARKET SHARE IMPACT: Highlighting Invokana's "quite strong" efficacy data, Wells Fargo analyst Larry Biegelsen argues that the safety events were "not unexpected" given the drug's previous label warnings. That said, Biegelsen believes the amputation risk will negatively impact Invokana's market share and he models sales falling from $1.4B this year to $1.2B in 2021, though CANVAS should still boost the overall SGLT-2 class. PRICE ACTION: Shares of Johnson & Johnson and Eli Lilly are both up fractionally in afternoon trading.

GRMN | Hot Stocks13:20 EDT Garmin: Navico's patent claims determined to be invalid by court of appeals - Garmin International announced that the Court of Appeals for the Federal Circuit reversed a December 2015 finding by the International Trade Commission that Garmin had infringed Navico patents related to downscan sonar. Specifically, the Federal Circuit ruled that two of Navico's patents were invalid and that Garmin's DownVu sonar does not infringe a third Navico patent. The Federal Circuit's decision not only reverses the ITC's original orders, but supersedes all related rulings by U.S. Customs and the ITC, including an initial determination that Garmin should be subject to a $37M fine for selling DownVu products. Garmin is now free to import and sell any and all sonar products. "The Federal Circuit's sweeping decision, finding that Navico's downscan technology was an obvious modification of old sonar systems, puts an end to Navico's unfounded and vicious patent war against Garmin," said Andrew Etkind, Garmin's vice president and general counsel. "Not only does the Federal Circuit's decision eliminate the ongoing disputes at the ITC, it renders Navico's other lawsuits in Oklahoma and Texas without merit." "This ruling confirms our strong belief that Navico's patent claims were not supported by the facts," said Cliff Pemble, Garmin's CEO. "Despite Navico's flood of lawsuits, and harassment of Garmin's dealers, distributors, and customers, the industry stood by us during this difficult and unnecessary fight and for that, we are extremely grateful. We look forward to a great 2017 filled with exciting new Garmin products."

AAPL | Hot Stocks12:39 EDT S&P rates Apple green bond AA+, sees iPhone 8 spurring growth - Responding to Apple's $1B "green" bond issue Tuesday -- the first environmentally-focused U.S. corporate issuance since President Donald Trump's decision to exit the Paris climate accord -- S&P Global Ratings assigned a AA+ rating to the notes, the same as its rating on the company itself. The credit rating agency commented: "Apple's financial risk profile is considered minimal. We view its periodic debt issuances as a form of synthetic cash repatriation and expect the company to maintain a significant net cash position over time... Although we expect total shareholder returns to exceed free cash flow on occasion, robust overall cash generation affords the company the flexibility to return large amounts of cash to shareholders without detracting from the overall credit quality... Despite the maturing smart phone market, we expect Apple to generate revenue growth near the mid-single digits in FY17. We believe the 10th anniversary edition of the iPhone, expected to launch later this year, will spur further growth into FY18. Our view of Apple's business risk profile remains unchanged at strong given its expanding ecosystem -- partly reflected in its growing services segment -- and its leadership position as a premium product with strong consumer loyalty."

SONC... | Hot Stocks11:06 EDT Sonic cut to sell on McDonald's aggressive value plans - Noting fast-food stocks have recently had a "strong run," citing factors including fund flows out of retail stocks and into restaurants and positive sales trends in the category, Bank of America Merrill Lynch analyst Gregory Francfort raised price targets across the space. However, he downgraded Sonic (SONC) to a sell-equivalent rating, citing the increasing aggressiveness of McDonald's (MCD), which the analyst still views as a top pick. SELL SONIC: Francfort downgraded Sonic two notches to Underperform from Buy but raised its price target to $30 from $27. The analyst said the downgrade is not a call on the quarter, as the company reports on June 22, and he sees limited downside to Q3 and Q4. However, he notes shares are up 29% since March 21 and Francfort is concerned about 2018 earnings as McDonald's is becoming more aggressive. He believes shares should trade at a discount to peers due to slower unit growth and higher capital intensity. TOP PICK: Francfort continues to view McDonald's as a top pick and sees further upside from aggressive value plans slated for early 2018 and unit economics. The fast-food chain announced a 55% reimage contribution to support a value menu based around $1, $2 and $3 price points, which could encourage franchisees to co-invest in price aggressiveness, Francfort writes. The analyst said McDonald's is one of the few restaurant companies that can increase franchisee economics through lower price points and can get more aggressive than peers due to higher margins. He added while unit growth for the chain is now negative, McDonald's continues "to screen cheap" on a relative basis compared to other highly franchised restaurant stocks. Francfort raised McDonald's price target to $175 from $165 based on FY18 earnings and reiterated his Buy rating. OTHERS TO WATCH: Other notable stocks in the fast-food space include Domino's Pizza (DPS), Dunkin' Brands (DNKN), Jack in the Box (JACK), Restaurant Brands International (QSR), Wendy's (WEN) and Yum! Brands (YUM). PRICE ACTION: Sonic rose 0.3% to $29.38, while McDonald's gained 0.8% to $149.65 in morning trading.

TSLA... | Hot Stocks10:38 EDT Tesla nears all-time high after bulls predict shares will surge - Tesla's (TSLA) stock is rallying and is near its all-time high after a billionaire investor and an analyst predicted that the stock will jump. Billionaire investor Ron Baron told CNBC that the automaker's shares will reach $500-$600 next year before reaching $1,000 in 2020, while Berneberg analyst Alexander Haissl upgraded the stock to Buy and increased his price target on the shares to a Street-high $464. $1,000 BY 2020: Baron, who said he bought 1.6M shares of Tesla about three and a half years ago, predicted that the company's revenue and operating profits would surge to $70B and $10B, respectively, in 2020 while appearing on CNBC this morning. Other automakers will not be able to eliminate Tesla's technology edge, according to Baron. However, CNBC noted that a number of tech giants, including Apple (AAPL), are working on autonomous driving. STREET-HIGH TARGET: Traditional automakers will not be able to compete with Tesla in the electric vehicle market as long as they continue to use a "low-risk, low cost approach," agrees Haissl. The analyst, who estimated that Tesla's investments in electric vehicles would be about 40% higher than that of Daimler (DDAIF) and Volkswagen (VLKAY), does not expect other automakers to adopt Tesla's strategy until the early 2020s. Tesla will "gain unencumbered market share for a longer period than expected," enabling it to become more profitable than other luxury automakers, the analyst stated. In the short-term, Tesla's profitability is "unimportant," as it will focus on gaining market share, according to Haissl. However, over the longer term its "cash profit per car" can exceed that of traditional automakers by more than 50%, "driven by best in class cost base and production processes and a high share of optional software content," wrote Haissl, who increased his price target on the shares to $464 from $193. PRICE ACTION: In early trading, Tesla rose 3.4% to $371. The stock's all-time high is $376.87.

The company now expects comparable sales at The Cheesecake Factory restaurants for the second quarter of fiscal 2017 to be down approximately 1%. SRSC | Hot Stocks07:53 EDT Sears Canada: Cash flows insufficient to meet obligations over next 12 months - The Company continues to face a very challenging environment with recurring operating losses and negative cash flows from operating activities in the last five fiscal years, with net losses beginning in 2014. While the Company's plans have demonstrated early successes, notably in same-store sales, the ability of the Company to continue as a going concern is dependent on the Company's ability to obtain additional sources of liquidity in order to implement its business plan. Based on management's current assessment, cash and forecasted cash flows from operations are not expected to be sufficient to meet obligations coming due over the next 12 months. In order to address the need for additional liquidity, the Company had expected to be able to borrow up to an additional $175M (before transaction fees) secured against its owned and leased real estate as part of the second tranche of its existing term loan. Based on the current status of negotiations with the lenders, the amount that the Company expects to borrow under the second tranche has been reduced to an amount up to $109M (before transaction fees). That, and the lack of available alternative sources of liquidity (through real estate monetizations, asset sales or otherwise), which may not be available in a timely manner, mean there are material uncertainties as to the Company's ability to continue to satisfy its obligations and implement its business plan in the ordinary course. Accordingly, such conditions raise significant doubt as to the Company's ability to continue as a going concern. As previously disclosed, the Company has been working on a transformation and brand reinvention. In the past year, the Company believes it has made substantial progress in regaining confidence from Canadian consumers as evidenced by its increased same store sales. The Company recently commenced a process to address its liquidity situation and to source and structure financial solutions and strategic alternatives to continue to finance its business and preserve and grow its franchise and brand reinvention. Such alternatives may include a financial restructuring or sale of the Company. A special committee of the Board of Directors has been established, comprised of independent directors, to assist the Board of Directors with this process. In order to assist the Company with this process, it has retained BMO Capital Markets, as a financial advisor, and Osler, Hoskin & Harcourt LLP, as a legal advisor.
